This User Agreement (hereinafter referred to as the "Agreement") is a legally binding contract between you (hereinafter referred to as the "User" or "You") and the Hi-et Platform (hereinafter referred to as "We", "Us" or "the Company"), governing your registration, login, and use of the Hi-et Platform and its related services. We legally own and operate the Hi-et social platform, including but not limited to official websites, iOS and Android mobile applications, application programming interfaces (APIs), mini-programs, web versions, and all related online functions and value-added services (collectively referred to as the "Platform" or "Services" hereinafter).
The Platform mainly provides registered users with comprehensive social and value-added services such as social interaction, personal profile display, information browsing, instant messaging, content publishing, intelligent translation, membership subscription, point consumption, and virtual currency recharge. It aims to create a safe, compliant, and convenient social environment for users, meeting their social needs and personalized experience.
By registering an account, accessing, browsing, downloading, installing, using any function of the Platform or accepting any services provided by the Platform, you are deemed to have fully read, completely understood, clearly recognized and unconditionally agreed to abide by all terms of this Agreement, our Privacy Policy, and all rules, announcements, and notices issued by the Platform (including but not limited to membership rules, point rules, virtual currency usage rules, collectively referred to as the "Platform Rules" hereinafter). If you do not agree to any terms of this Agreement, the Privacy Policy, or any content of the Platform Rules, you shall immediately stop accessing, downloading, and installing the Platform, cease using all related services, and shall not register an account or perform any subsequent operations; once you start using the Platform's services, you are deemed to have accepted all constraints of this Agreement and related rules.
1. Scope of Application and User Eligibility
1.1 Scope of Application
This Agreement applies to all users who access, browse, and use the Platform's services, including but not limited to free users, paid member users, temporary visitors, and users who log in quickly through third-party social accounts. This Agreement, together with the Privacy Policy and Platform Rules, constitutes a complete contract governing the rights and obligations between the User and Us. If there is any conflict between the terms of this Agreement and the Privacy Policy or Platform Rules, the terms that are more conducive to protecting the legitimate rights and interests of users and more in line with laws and regulations as well as the Platform's operational compliance requirements shall prevail; if there is no provision in this Agreement, the Privacy Policy and Platform Rules shall prevail.
1.2 User Eligibility
1.2.1 Age Requirement: You must be at least 18 years old (if the legal age of majority in your jurisdiction is higher than 18 years old, the legal age of majority shall prevail), have full capacity for civil conduct and full capacity for civil rights, and be able to independently bear all legal liabilities arising from the use of the Platform's services.
1.2.2 Prohibited Users: Any person who has been legally convicted of a sexual offense or violent crime, a registered sex offender, or a user whose account has been banned by Us due to violations of this Agreement, Platform Rules, or laws and regulations is prohibited from using the Platform's services. Users with banned accounts shall not re-register an account or use the Platform's services in any way (including but not limited to changing email addresses, devices, IP addresses, etc.) without Our prior written explicit permission. If you violate this provision, We have the right to immediately ban your newly registered account without assuming any liability for compensation.
1.2.3 Eligibility Statement: You represent and warrant that you meet the user eligibility specified in this Agreement and are not in any situation prohibited from using the Platform's services; your use of the Platform's services does not violate any applicable laws, regulations, or administrative rules, and does not infringe upon the legitimate rights and interests of any third party (including but not limited to intellectual property rights, privacy rights, reputation rights, portrait rights, etc.); all information you provide is true, accurate, complete, and valid, without any false or misleading statements or omissions.
You authorize us to conduct real identity verification, risk behavior detection and content review via authorized third-party service providers. All verification data shall only be used for compliance inspection and security management, and will not be improperly disclosed to irrelevant third parties.
1.2.4 Protection of Minors: The Platform strictly prohibits users under 18 years of age from using the services, and We do not actively collect any personal information of minors. If you discover that a minor has registered or used the Platform's services without authorization, or if you, as a guardian, find that a minor has mistakenly registered an account, please immediately contact Our customer service. After verifying the identity, We will immediately cancel the account and permanently delete the relevant personal data without retaining any backups.
2. Account Registration and Management
2.1 Account Registration
2.1.1 Registration Methods: You may register a Platform account through the following methods: (1) Registration using an email address; (2) Quick login and registration through an authorized third-party social account (if launched later). Regardless of the registration method, you must provide true, accurate, and complete registration information (including but not limited to username, email address, login password, etc.) in accordance with the Platform's prompts, and complete identity verification to successfully register an account.
2.1.2 Requirements for Registration Information: Account information such as username, avatar, and personal profile shall not contain any illegal, vulgar, pornographic, violent, hateful, insulting, defamatory, or third-party rights-infringing content, nor shall it violate public order and good customs. It shall not use names or avatars similar to those of Us or well-known third-party brands, celebrities, or institutions, nor shall it contain information that misleads others. If your registration information does not meet the above requirements, We have the right to refuse your registration application, or restrict functions, ban, or delete your registered account without assuming any liability for compensation.
Accounts failing real identity verification or concealing true personal information will be rejected for registration or restricted from using core platform functions.
2.1.3 Account Ownership: The ownership of the Platform account belongs to Us. You only obtain the right to use the account, and this right of use is only for your personal use. You shall not transfer, rent, lend, gift, or sell the account to any third party, nor share the account with a third party. If you violate this provision, resulting in account theft, abuse, or other losses, you shall bear full responsibility. We have the right to ban the account and will not refund any paid fees, unused points, or virtual currency.
2.2 Account Security
2.2.1 Obligation to Keep Account: You shall properly keep your account login credentials (including but not limited to username, password, verification code, bound email address, etc.) and bear full responsibility for all operations, behaviors, and consequences under the account. You shall not disclose your account login credentials to any third party or allow a third party to use your account. If you find that your account has been stolen, illegally accessed, abused, or has other abnormalities, you shall immediately contact Us through the in-Platform customer service channel or email, notify Us to take measures such as freezing the account and changing the password, and cooperate with Us in the investigation.
2.2.2 Division of Security Responsibilities: All consequences such as account theft, information leakage, property loss, and irregular operations caused by your improper custody, disclosure of account credentials, use of weak passwords, sharing of accounts with third parties, or non-Our reasons such as third-party fraud or hacking attacks shall be borne by you, and We shall not assume any liability for compensation. If your account is stolen or information is leaked due to Our own faults such as system vulnerabilities or technical failures, We shall bear corresponding liability for compensation within the scope stipulated by law, but shall not be liable for indirect losses beyond a reasonable scope.
2.2.3 Change of Account Information: You may modify personal information, passwords, bound email addresses, and other information in the Platform's "Me → Settings → Account Information" (some core information such as email address requires identity verification when modified). If your registration information changes (such as email address becoming invalid), you shall update the account information in a timely manner; otherwise, you shall bear all consequences caused by the information change, such as inability to receive Platform notifications, retrieve the account, or handle refunds.
2.3 Account Cancellation and Deletion
2.3.1 Right to Cancel: You have the right to apply for cancellation of your Platform account at any time. Before canceling the account, you shall ensure that there are no uncompleted transactions or unresolved disputes in the account, and have properly handled the relevant assets in the account such as points, virtual currency, and membership rights and interests (after account cancellation, all unused points, virtual currency, and membership fees will not be refunded unless the account becomes unusable due to Our faults).
2.3.2 Cancellation Process: You may apply for account cancellation through the following two methods: (1) Self-cancellation in the Platform: After logging in to the account, enter "Me → Settings → Account Security → Delete Account", complete identity verification in accordance with the Platform's prompts (such as entering the password, receiving the email verification code, etc.), and submit the cancellation application; (2) Cancellation with Customer Service Assistance: Send an email to Our customer service email address service@hi-et.com, provide account information and identity verification materials, and apply for account cancellation. We will process it after verifying the identity.
2.3.3 Cancellation Processing Time Limit: After receiving your cancellation application and completing identity verification, We will complete the account cancellation and related data deletion within 15 natural days (in line with Apple App Store mandatory requirements). After cancellation, the account cannot be recovered, and all personal information in the account (including but not limited to registration information, personal data, chat records, published content, browsing history, etc.) will be permanently deleted. Only necessary transaction records and financial records will be retained in accordance with the law (retention period is 12 months for tax and compliance inspections, etc.).
2.3.4 Handling of Dormant Accounts: If your account has no login or usage records for 12 consecutive months (including but not limited to no login, no message sending, no content browsing, no consumption, etc.), and there are no valid membership rights and interests, unused points, or virtual currency in the account, We will regard it as a dormant account and have the right to automatically cancel the account and permanently delete the relevant data without notifying you separately. You shall bear all losses arising therefrom. If there are valid membership rights and interests, unused points, or virtual currency in the account, We will remind you through email, in-Platform notification, etc. If there is still no usage behavior within 30 days after the reminder, it will be handled as a dormant account.
3. Platform Service Content and Usage Rules
3.1 Service Classification and Content
3.1.1 Basic Free Services: Free users can enjoy basic social services provided by the Platform, including but not limited to: creating personal accounts and personal profiles, browsing publicly published content by other users, searching for users, sending and receiving private messages (some functions are restricted, such as daily message sending limit), liking, commenting, following other users, and participating in public activities of the Platform.
3.1.2 Value-Added Paid Services: We provide value-added services such as Premium Membership (SVIP), Points, and Virtual Coins (Coins). Users need to purchase these services through payment to use the relevant value-added functions. The specific service content, price, validity period, etc., shall be subject to the real-time display on the Platform's purchase page. We have the right to reasonably adjust the content, price, and rules of value-added services according to the Platform's operation. After the adjustment, We will notify users through Platform announcements, emails, or in-app notifications. If users continue to purchase or use value-added services, they are deemed to accept the adjusted rules. The Platform does not provide an automatic renewal function, and users need to manually repurchase the membership after it expires to continue enjoying the membership rights and interests.
3.1.3 Specific Description of Value-Added Services:
(1) Points can be obtained by subscribing to Premium Membership for daily rewards, or purchased directly through official in-app purchase channels. Points are used for services such as sending private messages and content translation, with a charging standard of 1.5 points per character. Points have a validity period of 12 months from the date of acquisition. Unused points will automatically expire and cannot be reissued or refunded.
(2) Virtual Coins (Coins): Virtual Coins can be purchased through recharge with legal tender, and the recharge price shall be subject to the real-time display on the Platform. Virtual Coins have no equivalent value to legal tender, cannot be converted into cash, and cannot be transferred or gifted. Virtual Coins can be used for services such as sending photos, videos, virtual gifts, private messages, and content translation. Once recharged, Virtual Coins will not be refunded (unless the service becomes unavailable due to Our faults).
3.2 Payment Rules
3.2.1 Payment Channels: When purchasing value-added services or recharging Virtual Coins, users shall make payment through Our officially authenticated payment channels (including but not limited to officially authorized third-party payment platforms, in-app payment, etc.). Users shall not make personal recharge or consumption through unofficial channels, third-party personal accounts, or corporate public accounts. If users make payment through unofficial channels, all losses incurred (such as recharge failure, account theft, fund fraud, etc.) shall be borne by the users, and We shall not assume any liability. We also have the right to ban the relevant accounts.
3.2.2 Payment Security: All payment transactions are processed by Our authorized third-party payment service providers. We do not store users' complete payment card information, payment passwords, or other sensitive payment information. Payment data transmission adopts AES-256 encryption technology, which complies with the PCI DSS payment card industry security standard to ensure users' payment security.
3.2.3 Orders and Invoices: After successful payment, the Platform will generate an electronic order. Users can view the order details in "Me → Order Management". If users need an invoice, they can apply for an electronic invoice in the order details. We will issue and send it to the user's designated email address within 3 working days after receiving the application. The invoice issuance standard shall be in accordance with the relevant national tax regulations.
3.3 Platform Usage Norms
3.3.1 Restrictions on Usage Scope: The Platform is for the User's personal non-commercial use only. Users shall not use the Platform for any commercial activities, including but not limited to publishing advertisements, promoting goods or services, conducting pyramid schemes, organizing paid surveys, brushing orders, diverting traffic, reselling accounts, points, Virtual Coins, etc. If you violate this provision, We have the right to restrict account functions, ban the account, delete relevant content, and will not refund any paid fees. You shall bear all losses arising therefrom.
3.3.2 Content Publishing Norms: All content published by users on the Platform (including but not limited to personal data, avatars, dynamics, photos, videos, private messages, comments, etc.) must comply with laws, regulations, administrative rules, and Platform Rules, and shall not contain the following content:
(1) Content that violates national laws and regulations, including but not limited to endangering national security, disclosing state secrets, subverting state power, undermining national unity, inciting ethnic hatred and discrimination, advocating terrorism and extremism, advocating pornography, violence, gambling, drugs, etc.;
(2) Content that infringes upon the legitimate rights and interests of third parties, including but not limited to infringing upon others' intellectual property rights, privacy rights, reputation rights, portrait rights, name rights, etc., and using others' works, portraits, personal information, etc., without authorization;
(3) Vulgar, pornographic, violent, hateful, insulting, defamatory, maliciously attacking, or harassing content;
(4) False or misleading statements, including but not limited to false propaganda, false prize information, fraudulent content, etc.;
(5) Content containing viruses, Trojans, malicious codes, or other harmful programs, or content that may interfere with or damage the normal operation of the Platform;
(6) Content that violates public order and good customs and social morality;
(7) Other content that We deem inappropriate to be published on the Platform.
3.3.3 Behavioral Norms: In the process of using the Platform's services, users shall not engage in the following behaviors:
(1) Without Our permission, arbitrarily crawling or collecting Platform data and content, or interfering with or damaging the normal operation and server stability of the Platform through technical means, including but not limited to using robots, scripts, crawlers, and other tools to register accounts, send messages, like, comment, etc., in batches;
(2) Impersonating others (including but not limited to impersonating Our staff, celebrities, other users, etc.), forging or tampering with identity information, qualification certificates, etc., to mislead others;
(3) Harassing, threatening, or intimidating other users, sending spam or harassing information, or inducing other users to meet offline, conduct private transactions, etc.;
(4) Engaging in illegal and criminal activities such as prostitution, human trafficking, drug trafficking, weapons trading, financial fraud, and telecom fraud;
(5) Stealing or fraudulently using others' accounts, or assisting others in stealing or fraudulently using accounts, and disclosing others' account information and personal information;
(6) Maliciously slandering or smearing Our and the Platform's image, and spreading false information unfavorable to Us;
(7) Other behaviors that violate this Agreement, the Privacy Policy, and Platform Rules.
3.4 Content Review and Handling
3.4.1 Review Mechanism: We adopt a combined moderation system integrating intelligent risk control and manual review. The platform is equipped with Google anti-bot registration protection, R3 risk detection system, and full-category content moderation covering text, images and videos. Meanwhile, we cooperate with Persona and Veriff to conduct real identity verification for users. Professional manual reviewers will conduct final recheck on suspicious accounts, messages and published content, forming multi-layered supervision to maintain the safety and order of the Platform community.
3.4.2 Handling Measures: If We find that a user has irregular account information, irregular content, or irregular behaviors, We have the right to take one or more of the following handling measures according to the severity of the irregularity: (1) Remind the user to rectify; (2) Delete the irregular content; (3) Restrict some account functions (such as prohibiting content publishing, private message sending, commenting, etc.); (4) Freeze the account; (5) Ban the account; (6) Pursue the user's legal liability; (7) Report to the relevant regulatory authorities.
3.4.3 Disclaimer: We only conduct formal review on the content published by users and do not assume any responsibility for the authenticity, legality, accuracy, or completeness of the content. Users bear full responsibility for the content they publish. If third-party complaints or claims arise due to the irregular content published by users, or if We suffer losses, the user shall bear full liability for compensation, including but not limited to Our direct losses, indirect losses, attorney fees, litigation fees, etc.
4. Intellectual Property Rights
4.1 Our Intellectual Property Rights
All intellectual property rights of the Platform and related services, including but not limited to trademarks, copyrights, patents, trade secrets, technical secrets, software copyrights, interface designs, copywriting, pictures, icons, algorithms, data, etc., belong to Us or Our authorized parties and are protected by laws and regulations. Without Our prior written permission, users shall not arbitrarily copy, modify, spread, transfer, rent, sell, or distribute any content or derivative works of the Platform, nor shall they conduct reverse engineering, decompilation, disassembly, or other operations on the Platform. Any suggestions, opinions, ideas, improvement plans, etc., fed back by users to Us are deemed to be gratuitously granted to Us a permanent, global, free, and transferable right to use. We have the right to use them for Platform optimization, upgrading, and related services without paying any additional fees to users.
4.2 User's Intellectual Property Rights
Users enjoy legal intellectual property rights (including but not limited to copyrights, portrait rights, etc.) to all content published on the Platform (including but not limited to personal data, avatars, dynamics, photos, videos, private messages, comments, original copywriting, etc.), and users retain the ownership of such intellectual property rights. At the same time, users explicitly grant Us a permanent, global, free, transferable, and non-exclusive license to use, store, display, spread, copy, modify, and adapt such content in the process of providing Platform services, including but not limited to displaying publicly published content by users to other users and using it for Platform promotional materials, etc.
Users warrant that all content they publish is original or legally authorized, and does not infringe upon the intellectual property rights of any third party. If the content published by users infringes upon the intellectual property rights of a third party, leading to third-party complaints or claims, or causing Us to suffer losses, the user shall bear full liability for compensation, including but not limited to Our direct losses, indirect losses, attorney fees, litigation fees, compensation, etc.
5. Disclaimers and Liability Limitations
5.1 Service Disclaimers
5.1.1 The Platform's services are provided on an "as-is" and "as-available" basis. We do not promise that the services are uninterrupted, error-free, or bug-free, nor do We promise the stability, security, or timeliness of the services, nor do We promise that users' use of the services will necessarily achieve the expected results. We shall not be liable for any compensation for service interruptions, delays, errors, or user data loss, inability to access, etc., caused by technical failures, server maintenance, network congestion, force majeure (including but not limited to earthquakes, floods, typhoons, wars, policy adjustments, etc.), third-party service failures, etc., but We will make every effort to restore the services in a timely manner and notify users.
5.1.2 We shall not be liable for any social interactions or transactions between users. Any disputes arising between users due to the use of the Platform's services (including but not limited to verbal conflicts, property losses, rights and interests disputes, etc.) shall be resolved through friendly negotiation between the users themselves and have no connection with Us. If the dispute causes Us to suffer losses, the user shall bear full liability for compensation.
5.1.3 Any losses caused by non-Our reasons such as the user's own operational errors, equipment failures, network problems, or third-party software interference shall be borne by the user, and We shall not assume any liability for compensation.
5.2 Liability Limitations
Within the scope permitted by law, Our liability for compensation for any losses incurred by users due to the use of the Platform's services (including but not limited to direct losses, indirect losses, profit losses, data losses, mental damage, etc.) shall not exceed the total amount of fees paid by the user through the Platform within 3 months prior to the incident. If the user is a free user, We shall not assume any liability for compensation.
Users explicitly agree that We shall not be liable for any losses caused by the following circumstances: (1) The user violates this Agreement, the Privacy Policy, or Platform Rules; (2) The user's own fault; (3) Third-party behaviors (including but not limited to fraud, hacking attacks, account theft, etc.); (4) Force majeure; (5) Other circumstances exempted by laws and regulations.
5.3 Liability for Compensation
If the user violates this Agreement, the Privacy Policy, or Platform Rules, or if the user's own behavior infringes upon the legitimate rights and interests of a third party, or if the user's behavior causes Us to suffer losses (including but not limited to direct losses, indirect losses, attorney fees, litigation fees, fines, compensation, etc.), the user shall bear full liability for compensation, compensate Us for all losses, and eliminate the adverse effects.
6. Modification and Termination of the Agreement
6.1 Modification of the Agreement
We have the right to modify and update the terms of this Agreement at any time according to the Platform's operation, changes in laws and regulations, regulatory requirements, etc. The modified Agreement will be notified to users through Platform announcements, emails, in-app notifications, etc. If users continue to use the Platform's services after the modification of the Agreement, they are deemed to have fully read, understood, and agreed to the modified terms of the Agreement. If users do not agree to the modified terms of the Agreement, they shall immediately stop using the Platform's services and cancel their accounts; otherwise, they are deemed to accept the modified Agreement.
For major modifications to the Agreement (including but not limited to major adjustments to service content, charging standards, user rights and obligations, disclaimers, etc.), We will notify users through the above methods 7 working days in advance to ensure that users have sufficient time to understand the modified content.
6.2 Termination of the Agreement
6.2.1 Automatic Termination: If the user has no login or usage records for 12 consecutive months, and there are no valid membership rights and interests, unused points, or virtual currency in the account, We will automatically cancel the account and the Agreement will terminate automatically.
6.2.2 Active Termination by User: The user may actively terminate the Agreement by canceling the account. After the account is canceled, the Agreement will terminate immediately, and the user will no longer enjoy any rights or bear any obligations stipulated in the Agreement.
6.2.3 Active Termination by Us: If the user violates this Agreement, the Privacy Policy, or Platform Rules with serious circumstances (including but not limited to malicious violations, repeated violations, infringement of third-party rights and interests, endangering Platform security, etc.), We have the right to immediately ban the user's account and terminate the Agreement, and will not refund any paid fees, unused points, or virtual currency. If We have the right to terminate the Agreement due to changes in laws and regulations, regulatory requirements, Platform suspension of operations, etc., We will notify users 30 working days in advance and properly handle the user's relevant assets (such as unused membership rights and interests, points, virtual currency, etc., which will be refunded or handled in accordance with relevant rules).
6.2.4 Effect after Termination of the Agreement: After the termination of the Agreement, the user shall immediately stop using the Platform's services, and We will no longer provide any services to the user. After the termination of the Agreement, the user shall still bear the relevant liabilities arising from the use of the Platform's services (including but not limited to liability for compensation for irregular behaviors, liability for intellectual property infringement, etc.), and We still have the right to retain the user's relevant data (handled in accordance with the Privacy Policy).
7. Dispute Resolution and Applicable Law
7.1 Applicable Law
The conclusion, performance, interpretation, and dispute resolution of this Agreement shall all be governed by the laws of the State of California, United States, excluding conflict of laws rules. If the laws of the State of California conflict with the mandatory legal provisions of the user's jurisdiction, the mandatory legal provisions shall prevail.
7.2 Dispute Resolution
Any disputes arising between the user and Us due to this Agreement, the Privacy Policy, or the Platform's services shall first be resolved through friendly negotiation between the two parties. If the negotiation fails, either party has the right to file a lawsuit with the Superior Court of California, County of San Francisco, United States. Both parties agree to submit to the exclusive jurisdiction of this court and waive the right to a jury trial and class action.
During the dispute resolution process, except for the disputed matters, other terms of this Agreement shall remain valid, and both parties shall continue to perform their respective obligations.
8. Other Terms
8.0 Compliance Specifications
The Platform complies with Apple ATT framework, Google Play data security policies and California CCPA/CPRA regulations. User personal data, verification information and usage records are processed strictly in accordance with applicable privacy laws, and legitimate user rights and data security are fully protected.
8.1 If any term of this Agreement is deemed invalid, voidable, or unenforceable, it shall not affect the validity of other terms, and the other terms shall continue to be performed.
8.2 Our failure to exercise or delay in exercising any right stipulated in this Agreement shall not be deemed a waiver of such right, nor shall it affect Our subsequent exercise of such right.
8.3 Any notices and communications between the user and Us may be conducted through in-Platform notifications, emails, etc. Emails sent to the user's bound email address or Our customer service email address service@hi-et.com shall be deemed effectively delivered.
8.4 This Agreement constitutes a complete contract between the user and Us regarding the use of the Platform's services, replacing any oral or written agreements or understandings reached between the two parties on relevant matters prior to this Agreement.
8.5 If you have any questions, suggestions, or complaints about this Agreement, you may contact Us through the customer service email address service@hi-et.com. We will give an initial reply within 1-2 working days and complete the handling within a reasonable time limit.
